^✦❅ PROCESS• My standard turnaround time (TAT) is up to 3 months, unless otherwise stated. And it only begins once payment, references, and any required information have all been received.• Commissioners are responsible for providing clear references before work begins. Additional references or major changes after work has started may require revision fees or may be declined.• You are entitled to up to three (3) major revisions during the sketch phase. Additional revisions may be declined or require an additional fee.• Once the sketch has been approved, only reasonable minor edits (such as eye color changes, small accessories, scars, or similar details) are free of charge.• Major revisions after sketch approval—including pose changes, composition changes, redesigns, or substantial alterations—may be declined or require an additional fee.• Delays caused by waiting for your references, approvals, responses, or outstanding payments do not count toward my turnaround time.• Work may be completed in any order. The order in which commissions are finished does not necessarily reflect the order in which they were accepted._✦

• I retain full copyright to my artwork and may use commissioned pieces for my portfolio, galleries, social media, commission examples, or promotional purposes unless a private commission has been purchased.• Commissioned artwork is for personal use, including profile pictures, wallpapers, personal galleries, roleplay, stories, streams, videos, and similar non-commercial uses, unless commercial rights have been purchased.• Purchasing a commission does not transfer the copyright or ownership of the artwork unless explicitly agreed upon in writing.• You may repost or share your commissioned artwork with proper credit.• Monetized personal use (such as Twitch streams, YouTube videos, VTubing, social media content, or promoting yourself or your brand) is completely allowed with proper credit and does not require commercial rights.• You may not claim my artwork as your own, remove my signature or credits, trace it, heavily edit it, or use it for AI training, machine learning, image generation or editing, NFTs, blockchain technology, cryptocurrency, datasets, or similar technologies._✦

^✦❅ COMMERCIAL USE• Commercial rights are available for an additional 30% of the commission price, unless otherwise stated.• Commercial rights are required for merchandise or products sold for profit, including (but not limited to) charms, prints, posters, apparel, stickers, keychains, plushies, branding, advertisements, packaging, and similar commercial products.• Credit must be provided whenever the artwork is publicly displayed or used commercially, unless otherwise agreed._✦

^✦❅ REFUNDS• If my turnaround time exceeds 3 months (excluding delays caused by waiting for your response, approvals, references, or payment), you may request a refund. Refund amounts may vary depending on the amount of work already completed.• If I cancel your commission for any reason, you are entitled to a full refund, regardless of how much work has already been completed.• If you cancel your commission before work has begun, you may receive a full refund.• If you cancel your commission after work has started, refunds are provided at my discretion based on the amount of work already completed.• Completed commissions are non-refundable._✦

^✦❅ GENERAL• I reserve the right to decline or cancel any commission for any reason.• Commission openings are not First Come, First Serve (FCFS). I review every submission and select the commissions that best fit my interests and current workload.• Failure to respond for 30 consecutive days may result in your commission being considered abandoned and placed on hold until communication resumes.• I reserve the right to restart, reschedule, place on hold, or cancel a commission if communication has been inactive for an extended period due to the commissioner's absence. If a commission is cancelled under these circumstances, any refund will be determined based on the amount of work already completed.• Clients who require their commission to remain private (NDA) must request privacy before work begins or before the artwork is publicly posted. Privacy requests made after public disclosure cannot guarantee removal of previously published copies or undo prior public exposure.• High-resolution, unwatermarked files will only be delivered after the commission has been paid in full.• Layered source files (e.g. Procreate files) are not included unless otherwise agreed upon.• Unless a private commission has been purchased, I may post works-in-progress and finished artwork on my portfolio, social media, commission examples, or galleries.• By commissioning me, you confirm that you have the rights or permission to use any characters, references, or materials you provide.• If certain details are unclear or unspecified, I may use reasonable artistic interpretation.• Filing a fraudulent or unauthorized payment dispute or chargeback without attempting to resolve the issue with me first may result in a permanent blacklist._✦

^✦❅ DO NOT• Request tight deadlines or rush orders unless I explicitly offer them.• Negotiate or haggle prices.• Request services outside my listed offerings.• Request excessive progress updates.• Request major alterations near completion.• Claim my artwork as your own.• Remove my signature or credits.• Trace, heavily edit, or redistribute my artwork without permission.• Use my artwork for AI training, machine learning, image generation, NFTs, blockchain technology, cryptocurrency, datasets, or similar technologies, even for personal use.• Commission mature content without valid age verification.• Impersonate me or falsely imply that I endorse you, your project, brand, or business.

Please keep my designs on Toyhou.se and do not remove designer credits, artist credits, or character history.• Do not delete the Toyhou.se profile of one of my designs. Character profiles serve as a permanent ownership record and help prevent theft. Deleting a profile will result in being blacklisted. If you no longer want a design, you may sell, trade, gift, or return it to me, but returned designs are not refundable.• My designs and artwork may not be used for AI training, machine learning, NFTs, blockchain technology, cryptocurrency, or similar technologies.• I reserve the right to revoke ownership of a design obtained through fraud, theft, chargebacks, or other serious violations of these Terms of Service._✦

^✦❅ TRADE / RESELLING
• You may trade, gift, or resell my designs.• A design's monetary worth permanently follows the character throughout every owner. Ownership changes do not reset its value.• You may not resell a design for more than its total monetary worth.• A design's worth may only increase through finished artwork that has been uploaded to the ToyHou.se profile. Pending, unfinished, or unposted commissions cannot be included in the character's total worth. Pending commissions may be listed separately but must not count toward the resale value.• Commissioned or personal artwork may increase a design's worth. When assigning value to commissioned artwork, you must be able to provide proof that you consistently sell commissions of a similar type, quality, and size for that amount. Pricing should reflect your average commission rates, not one-time exceptions or unusually expensive sales.• Gift art, raffle art, unsolicited artwork, or free artwork should not significantly increase a design's value.• Please do not transfer my designs to users without ToyHou.se accounts, hide them from me, or knowingly trade them to scammers or blacklist evaders.• By transferring one of my designs, you agree to provide the new owner with access to these Terms of Service.• Once a design has been owned for 2 weeks, refunds are no longer available, as the owner will already have permanent access to the unwatermarked artwork.• If I reacquire one of my own designs through buying, trading, gifting, or any other means, I reserve the right to redesign it, add new artwork, and reauction or resell it._✦

^✦❅ USAGE• You may create artwork, lore, alternate forms, outfits, headcanons, and other personal content for the character. You may also change their name, story, gender, pronouns, or personality.• You may upload, archive, or store copies of your character's artwork for personal use, provided all credits and watermarks remain intact.• You are entitled to reasonable minor edits after receiving the design (such as eye color changes, scars, minor body type adjustments, accessories, etc.)• I reserve the right to decline requested edits that would substantially alter the design's identity.• Minor to moderate redesigns are allowed as long as the design remains recognizable.• You may not steal, copy, trace, heavily edit, or use my original artwork for AI training, machine learning, AI image generation or editing, datasets, NFTs, blockchain technology, cryptocurrency, or similar technologies.• Editing the character's information (such as their name, description, profile formatting, lore, etc.) is completely okay.• If changes or edits to the original artwork itself are needed, please contact me first.• Characters may be used in personal projects such as roleplay, stories, comics, animations, streams, videos, and similar works, provided I remain credited as the original designer.• Purchasing a design transfers ownership of the character, but not the copyright to my original artwork, unless explicitly stated otherwise._✦
